For standard expungement of an indictable offense (New Jersey's equivalent of a felony), you must wait ten years from the date of conviction, payment of fines, satisfactory completion of probation or parole, or release from incarceration — whichever is later — and you must not have been convicted of any prior or subsequent indictable offense.
The early pathway allows expungement after five years from the date of your most recent conviction, provided you have paid all court-ordered financial assessments, completed probation or parole, and been released from incarceration, and the court finds expungement is in the public interest.
For disorderly persons and petty disorderly persons offenses, you may petition for expungement after five years from the date of conviction, payment of fine, completion of probation, or release from incarceration, whichever is later.
The Clean Slate provision (N.J.S.A. 2C:52-5.3) allows expungement of all eligible convictions in a single petition if ten or more years have passed since your most recent conviction, payment of fine, completion of probation, or release from incarceration.
You must have no pending criminal charges at the time of filing, and you must have fully satisfied all court-ordered financial obligations including fines, restitution, assessments, and penalties.
Municipal ordinance violations may be expunged after two years from the date of conviction, and juvenile adjudications may be expunged after five years from the date of the adjudication or discharge from court supervision.
Important exceptions: New Jersey permanently excludes certain serious offenses from expungement eligibility regardless of how much time has passed. Convictions for murder, manslaughter, treason, anarchy, kidnapping, sexual assault, aggravated sexual assault, robbery, arson, perjury, and false swearing can never be expunged. Convictions for any crime committed by a person holding any public office or position of employment if the crime involved or touched such office are also permanently ineligible. For drug offenses, convictions involving the sale or distribution of controlled dangerous substances are generally excluded from expungement — with narrow exceptions for marijuana (25 grams or less) or hashish (5 grams or less), and third or fourth degree CDS offenses where the court finds expungement consistent with public interest. Convictions for endangering the welfare of a child, luring or enticing a child, and human trafficking are also categorically excluded from relief.
